These Terms & Conditions apply to all products and services offered by www.akxshplanet.com including original oil paintings, art prints, and custom commissioned oil paintings. By placing an order, submitting a deposit, or purchasing any product from our website, you confirm that you have read, understood, and agreed to all terms outlined in this document.
PART A — GENERAL TERMS (All Products)
1. About Our Business
Akxsh Planet is an Alberta-based fine art company offering original oil paintings, limited edition and open edition art prints, and custom commissioned oil paintings. All products are created by a professional artists operating in Alberta, Canada. Governed by: Alberta Business Corporations Act, RSA 2000, c. B-9; Alberta Partnership Act, RSA 2000, c. P-3.
2. Pricing & Currency
All prices are listed in Canadian dollars (CAD). Prices are subject to change without notice. The price charged is the price displayed at the time of purchase. All applicable taxes are added at checkout. Governed by: Alberta Consumer Protection Act, RSA 2000, c. C-26.3, Section 7(1)(e) — prohibition on misleading price representations; Section 11 — full disclosure of total price including taxes.
3. Taxes
Federal Goods and Services Tax (GST) of 5% is applied to all sales. Alberta has no provincial sales tax (PST). International clients are responsible for all applicable import duties, customs fees, and local taxes at their destination. Governed by: Excise Tax Act, RSC 1985, c. E-15, Section 165(1) — 5% GST on taxable supplies; Section 240 — mandatory GST registration threshold of $30,000 annual revenue.
4. Payment Methods
We accept the following payment methods: credit card (Visa, Mastercard, American Express), Interac e-transfer, PayPal, and Stripe. All transactions are processed securely. 5. Internet Sales Contract Disclosure
For all online purchases, the following information is disclosed at the time of purchase in compliance with Alberta law:

6. Delivery & Shipping
All products are shipped via tracked and insured courier. Estimated delivery timelines are provided in good faith and may vary due to courier delays, customs processing, or circumstances beyond our control. We are not liable for losses arising from shipping carrier delays. A tracking number is provided for every shipment. Governed by: Alberta Consumer Protection Act, RSA 2000, c. 7. Copyright & Intellectual Property
The artist retains full copyright and moral rights of all original artworks, prints, and commissioned works. Purchase of any physical product does not constitute transfer of copyright. The buyer may not reproduce, print, license, distribute, or commercialize any artwork image without prior written consent from the artist.

8. Portfolio & Promotional Use
We reserve the right to photograph and display all artworks — including original paintings, prints, and commissioned works — in our portfolio, website, social media, and promotional materials. Clients requesting confidentiality for commissioned works must submit a written request prior to commencement of production. Governed by: Canadian Copyright Act, RSC 1985, c. C-42, Section 13(1) — artist retains all reproduction and display rights.
9. Governing Law & Jurisdiction
These Terms & Conditions are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes arising from a purchase or commission agreement shall first be addressed through direct written communication. Unresolved disputes shall be submitted to Alberta jurisdiction. Governed by: Judicature Act, RSA 2000, c. J-2, Section 17 — Alberta courts have jurisdiction over contracts formed in Alberta; Federal Courts Act, RSC 1985, c. F-7 — federal jurisdiction for intellectual property matters under the Copyright Act.
10. Unfair Practices
We are committed to honest, transparent, and fair business practices. We will not make false or misleading representations about our products, pricing, quality, or timelines. Governed by: Alberta Consumer Protection Act, RSA 2000, c. C-26.3, Sections 6 & 7 — prohibition on unfair practices and misleading representations; Consumer Bill of Rights — Right to be Informed and Right to Fair Business Practices.
PART B — ORIGINAL OIL PAINTINGS
11. Original Artwork Description
Each original oil painting is a unique, hand-painted, one-of-a-kind artwork created on stretched canvas or board. Artwork dimensions, medium, and year of creation are listed on each product page. Original artworks are sold as described. Governed by: Sale of Goods Act, RSA 2000, c. S-2, Section 16 — goods sold by description must correspond to that description.
12. Certificate of Authenticity
Every original oil painting is accompanied by a hand-signed Certificate of Authenticity (COA) including the artwork title, medium, dimensions, date of completion, and the artist's original signature. The COA confirms the work as a unique, hand-crafted original. Governed by: Canadian Copyright Act, RSC 1985, c. C-42, Section 13 — confirms sole authorship; CARFAC (Canadian Artists' Representation / Front des artistes canadiens) National Standards for professional documentation of original artworks.
13. Returns & Refunds — Original Paintings
Original oil paintings may be returned within 14 days of confirmed delivery if the artwork arrives in a condition significantly different from its description on the product page. To initiate a return:
· Contact us in writing within 14 days of delivery.
· Provide photographic evidence showing the condition discrepancy.
· The artwork must be returned in its original packaging in undamaged condition.
· Upon receipt and verification, a full refund will be issued excluding original shipping costs.
Change-of-mind returns are accepted within 14 days provided the artwork is returned undamaged in its original packaging. Return shipping costs are the responsibility of the buyer. 14. Damaged Original Paintings on Arrival
All original paintings are professionally packaged and fully insured for shipping. In the event of damage during shipping:
· Notify us in writing within 48 hours of confirmed delivery.
· Provide clear photographic evidence of both the damage and the packaging.
· We will arrange repair, replacement, or full refund at our discretion.
· Claims submitted after 48 hours of confirmed delivery cannot be accepted.

15. Artist's Resale Right
Under Canada's Copyright Act as amended, an Artist's Resale Right (ARR) entitles the artist to a royalty of 5% on the resale price of original artworks sold for $1,000 or more on the secondary market. Buyers acknowledge this right exists under Canadian law. Governed by: Canadian Copyright Act, RSC 1985, c. C-42 — Artist's Resale Right provisions; CARFAC advocacy for ARR implementation in Canada.
PART C — ART PRINTS
16. Types of Prints
We offer the following types of art prints:
· Exclusive / Limited Edition Prints — A fixed number of prints produced from an original artwork. Each print is numbered (e.g., 12/50), signed by the artist, and accompanied by a Certificate of Authenticity.
· Classic / Open Edition Prints — Prints produced without a fixed quantity limit. Open edition prints are not individually numbered but classic Akxsk Planet embossed stamped.
· Premium / Open Edition Prints — Prints produced without a fixed quantity limit. Open edition prints are not individually numbered but original embossed stamped.
All prints are produced using archival-quality inks and materials for maximum longevity. Governed by: Sale of Goods Act, RSA 2000, c. C-26.3, Section 7 — prohibition on misleading representations about edition size or exclusivity.
17. Print Specifications
Dimensions, paper or canvas type, ink type, and edition details are listed on each product page. Minor color variations between screen display and printed output are inherent to the print production process and do not constitute grounds for a return or refund. Governed by: Sale of Goods Act, RSA 2000, c. S-2, Section 16 — correspondence to description; Alberta Consumer Protection Act, RSA 2000, c. C-26.3, Section 7(1) — disclosure of product characteristics.
18. Certificate of Authenticity — Prints
Every Exclusive / limited edition print is accompanied by a signed Certificate of Authenticity including the artwork title, edition number, total edition size, medium, dimensions, date, and the artist's original signature. Governed by: Canadian Copyright Act, RSC 1985, c. C-42, Section 13 — confirms authorship; CARFAC National Standards for limited edition print documentation.
19. Returns & Refunds — Prints
Art prints may be returned within 14 days of confirmed delivery provided:
· The print is returned undamaged in its original packaging.
· A written return request is submitted within 14 days of delivery.
· Return shipping costs are the responsibility of the buyer.
Prints damaged during return shipping cannot be refunded. Upon receipt and verification of condition, a full refund will be issued excluding original shipping costs. 20. Damaged Prints on Arrival
In the event a print arrives damaged:
· Notify us in writing within 48 hours of confirmed delivery.
· Provide clear photographic evidence of both the damage and the packaging.
· We will replace the print or issue a full refund at our discretion.
· Claims submitted after 48 hours of confirmed delivery cannot be accepted.

PART D — CUSTOM COMMISSIONED OIL PAINTINGS
21. Custom & Made-to-Order Products
All custom oil paintings are hand-crafted and made-to-order specifically for each client. By placing a commission order and submitting a deposit, the client acknowledges that the artwork is produced exclusively for them and agrees to all terms (Instructions included) in this Part D. Governed by: Alberta Consumer Protection Act, RSA 2000, c. C-26.3, Section 2 — definition of consumer transactions involving goods supplied to a buyer's specific requirements.
22. Commission Agreement
A commission is formally accepted upon receipt of the 50% deposit and written confirmation from both parties. The commission agreement includes the approved reference photo, canvas size, agreed total price, and estimated completion timeline. The client's written email confirmation constitutes a legally binding agreement. Governed by: Common Law principles of Offer, Acceptance, and Consideration; Judicature Act, RSA 2000, c. J-2, Section 17 — enforceability of contracts formed in Alberta.
23. Reference Photo Responsibility
The client is solely responsible for ensuring all submitted reference photos are legally owned by the client or that full rights and permissions exist to use them for commissioned artwork purposes. By submitting a reference photo, the client confirms legal ownership or usage rights. We accept no liability for copyright infringement arising from client-submitted materials. Governed by: Canadian Copyright Act, RSC 1985, c. C-42, Section 13(1) — ownership of copyright; Section 27 — infringement of copyright.
24. Reference Photo Review
Every submitted reference photo is reviewed against our photography guidelines within 24 – 48 business hours. We verify resolution, lighting quality, composition, and canvas ratio compatibility. Production does not begin until a suitable reference photo is formally approved in writing. If the submitted photo does not meet requirements, we will contact the client with clear instructions for resubmission. Governed by: Alberta Consumer Protection Act, RSA 2000, c. C-26.3, Section 6 — supplier obligation to confirm goods meet agreed specifications before commencement.
25. Deposit & Payment Terms
· A non-refundable deposit of 50% of the total commission price is required to secure the commission slot and begin production.
· The remaining balance of 50% is due within 2 months of the initial deposit payment date, upon written approval of the completed painting, prior to varnishing, signing, and shipping.
· Paintings will not be varnished, signed, or shipped until the final balance is received in full.
· Failure to remit the final balance within the agreed timeframe may result in the painting being listed for public sale, with the deposit forfeited.

26. Production Timeline
Standard production time is 20 – 24 weeks from the date of deposit to delivery. Timelines may vary based on commission complexity, reference photo approval delays, or shipping carrier circumstances. We will communicate any significant delays promptly. We are not liable for losses or damages arising from delays outside our reasonable control. Governed by: Alberta Consumer Protection Act, RSA 2000, c. C-26.3, Section 7(1)(f) — prohibition on misrepresenting delivery timelines; Section 13(2)(d) — internet contracts must disclose estimated delivery date.
27. Work-in-Progress Reviews
Two work-in-progress (WIP) review rounds are included with every commission at no additional charge:
· WIP #1 — Sketch and block-in stage (Week 2–4): Overall composition and proportions confirmed.
· WIP #2 — Near-completion stage (After final balance): Full color, detail, and rendering confirmed.
The client must respond to each WIP review within 3 business days. No structural changes are accepted after WIP #2 final written approval is received. 28. Artistic Interpretation
Custom oil painting is an artistic interpretation and not a photographic reproduction. Minor variations in color, proportion, light, and detail from the reference photo are inherent to the nature of hand-painted artwork. Such variations do not constitute grounds for refund, dispute, or cancellation. Governed by: Alberta Consumer Protection Act, RSA 2000, c. C-26.3, Section 7 — artistic variation does not constitute unfair practice when the nature of the product is clearly disclosed; Sale of Goods Act, RSA 2000, c. S-2, Section 16.
29. Revisions Policy
· Two rounds of minor revisions are included at no additional charge.
· Minor revisions include small adjustments to color tone, contrast, or detail within the existing composition.
· Major revisions — including changes to subject matter, composition, or significant structural elements — requested after production begins may incur an additional fee agreed upon in writing.
· No revisions of any kind are accepted after final written approval has been given.

30. Cancellation Policy — Custom Commissions

31. No Returns on Custom Commissions
Custom oil paintings are made-to-order and are exempt from standard return policies under Alberta law. Once production has commenced, orders are non-returnable and non-refundable, except in cases of verified shipping damage as outlined in Section 32. Governed by: Alberta Consumer Protection Act, RSA 2000, c. C-26.3, Section 13(9) — exemption for custom-made goods; Sale of Goods Act, RSA 2000, c. S-2, Section 17 — implied conditions do not apply to goods made to buyer's specific requirements.

PART E — PRIVACY & PERSONAL INFORMATION
34. Collection of Personal Information
We collect personal information — including name, organization name, email address, phone number, mailing address, and reference photos — solely for the purpose of processing orders and fulfilling commissions. We collect only the information necessary for these purposes. Governed by: Alberta Personal Information Protection Act (PIPA), SA 2003, c. P-6.5, Section 7 — consent required for collection; Section 11 — collection limited to what is necessary.
35. Use of Personal Information
Personal information is used only to fulfill your order, process payment, arrange shipping, and communicate with you regarding your purchase or commission. We do not use your information for marketing purposes without your explicit consent. Governed by: Alberta PIPA, SA 2003, c. P-6.5, Section 17 — personal information may only be used for the purpose for which it was collected.
36. Reference Photo Confidentiality
Reference photographs submitted for custom commissions are kept strictly confidential and used only for painting production. 37. Third-Party Disclosure
Shipping details are shared only with our designated courier for delivery purposes. Payment information is processed securely through third-party payment processors and is never stored on our servers. No personal information is sold or rented to any third party. 38. Data Retention
Commission-related and order-related personal data is retained for 3 years following order completion for legal, accounting, and record-keeping purposes. 41. Dispute Resolution
We are committed to resolving all disputes promptly and fairly. In the event of a dispute:
1. Contact us in writing with a full description of your concern.
2. We will respond within 5 business days with a proposed resolution.
3. If the matter remains unresolved, either party may file a complaint with Service Alberta (Consumer Protection Division) or seek resolution through Alberta Small Claims Court for claims up to $50,000.
